Terms of Service

Important notice: These Terms contain binding legal provisions, including disclaimers of warranties, limitations of liability, indemnification obligations, and dispute-resolution clauses. Please read them in full. If you do not agree, do not access or use Mera Samaj.
These Terms should be read together with our Privacy Policy. Community administrators and leaders should also ensure their community rules are consistent with applicable law.
1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you and Seon Consulting Services, operating the brand and product Mera Samaj ("Mera Samaj", "Company", "we", "us", or "our"), with operations at 105-3/2/7, Masab Tank, Hyderabad, Telangana, India, governing your access to and use of:
- the Mera Samaj mobile applications (including Android package
app.merasamaj.mobileand any successor package identifiers); - the Mera Samaj web application and community portals;
- the website at merasamaj.co.in and related domains;
- application programming interfaces, notifications, support channels, and any other products or services we make available (collectively, the "Platform" or "Services").
By creating an account, clicking "I agree", continuing past an onboarding consent screen, verifying your identity via OTP, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Definitions
In these Terms:
- "Community" means a samaj, association, organisation, chapter, or other group registered on or managed through the Platform.
- "Community Administrator" or "Community Admin" means a user with elevated permissions to configure, govern, moderate, publish to official channels, export reports, approve members, enable or disable features, and otherwise manage a Community, including roles such as community admin, sub-admin, community head, city head, moderator, leader, and equivalent designations.
- "Community Rules" means policies, codes of conduct, membership criteria, moderation standards, and other rules adopted by a Community Administrator for that Community.
- "Content" means any information, text, graphics, photos, videos, audio, files, metadata, listings, profiles, messages, reactions, comments, polls, advertisements, event details, matrimony data, job postings, business listings, SOS alerts, AI prompts or outputs, or other material uploaded, transmitted, generated, edited, stored, shared, broadcast, syndicated, promoted, archived, or deleted through the Platform.
- "User", "you", or "your" means any individual or entity that accesses or uses the Platform, including Community Administrators and members.
- "User-Generated Content" or "UGC" means Content that originates from or is submitted, modified, or republished by a User or Community Administrator, excluding Content that we alone create and publish as the Company.
3. Acceptance, Eligibility & Authority
3.1 Capacity
You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms. If you use matrimony, marketplace, payment, contractual, or other age-restricted features, you represent that you meet any higher age or eligibility requirements applicable to those features.
3.2 Organisation use
If you accept these Terms on behalf of a Community, trust, company, or other legal entity, you represent that you have authority to bind that entity. That entity is jointly responsible for activity conducted through its accounts and administrators.
3.3 Changes to Terms
We may modify these Terms from time to time. For material changes, we will provide notice where practicable through the Platform, by email or SMS where available, or by updating the "Last updated" date, with at least thirty (30) days advance notice before the change takes effect when a longer period is reasonably achievable. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance. If you do not agree to material changes, you must stop using the Platform and may request account deletion as described in our Privacy Policy. Non-material changes (for example clarifications, formatting, or updates reflecting new features that do not reduce your rights) may take effect upon posting.
3.4 Electronic records and consent
You agree that electronic communications, click-through acceptances, OTP verification, in-app consent screens, and account actions constitute your electronic signature and binding consent under the Information Technology Act, 2000 and applicable Indian law. OTP sent to your registered mobile number may be used to authenticate account creation, login, sensitive settings changes, and deletion requests. You are responsible for securing access to your phone and OTP messages.
4. Platform Role, Intermediary Status & No Editorial Control
THIS SECTION IS ESSENTIAL. PLEASE READ CAREFULLY.
4.1 Technology provider only
Mera Samaj provides software infrastructure that enables Communities to communicate, organise, and transact. We are a technology platform and intermediary. We do not create, initiate, select the recipient of, or modify User-Generated Content except where strictly necessary for technical operation, security, legal compliance, automated filtering configured by a Community, or as expressly described in these Terms.
4.2 Safe harbour under Indian law
To the fullest extent permitted by applicable law, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), we operate as an intermediary and/or social media intermediary (as applicable based on our user base and regulatory classification). Our liability for third-party or User-Generated Content is limited as permitted by law when we observe applicable due diligence, grievance, and takedown obligations.
4.3 No publisher or editor
We are not the publisher, editor, author, broadcaster, distributor, curator, or guarantor of User-Generated Content. Display, indexing, caching, syndication tooling, search, ranking, notification delivery, translation, formatting, thumbnail generation, link previews, automated moderation scoring, or temporary storage of Content does not constitute adoption, endorsement, verification, or assumption of responsibility for that Content by Mera Samaj.
4.4 No endorsement of user or admin content
We do not endorse, sponsor, recommend, or guarantee any User-Generated Content—including posts, comments, matrimony profiles, marketplace listings, job postings, microstore products, fundraising campaigns, official community announcements, news items, advertisements, or live-session statements—whether created by members or Community Administrators. References to third-party products, services, employers, matrimonial candidates, charities, or businesses on the Platform are informational only and do not imply our approval, affiliation, or verification unless we expressly state otherwise in writing.
4.5 No duty to monitor
Except as required by law or expressly stated in these Terms, we have no obligation to monitor, pre-screen, review, verify, authenticate, or investigate User-Generated Content or user conduct. Any moderation tools we provide are offered for Community and user safety convenience only and do not create an undertaking to detect or remove all harmful Content.
4.6 No reliance
You agree that you will not rely on Mera Samaj for legal, medical, matrimonial, financial, employment, emergency, religious, or other professional advice. Content on the Platform reflects the views of Users only.
5. Community Administration & Leader Control
5.1 Operational control by Community Administrators
Each Community is primarily governed by its Community Administrators. Subject to Platform-wide policies and applicable law, Community Administrators may, through tools we provide:
- approve, reject, suspend, or remove members;
- publish, edit, promote, demote, archive, or delete posts, comments, news items, announcements, and official feed content;
- configure privacy defaults, feature toggles, moderation levels, rate limits, and membership requirements;
- moderate, flag, reject, or restore User-Generated Content;
- export member reports, analytics, or directory data permitted by their role;
- request promotion of member posts to official channels or syndicate approved Content to external social platforms where enabled;
- appoint sub-admins, moderators, leaders, and other roles;
- enforce Community Rules and remove Content that violates those rules.
5.2 Community Administrators are responsible parties
Community Administrators—not Mera Samaj—are primarily responsible for the Content, conduct, compliance, and member management of their Community. By accepting an administrative role, a Community Administrator agrees that they, and the Community they represent, bear primary responsibility for ensuring Content and activities comply with applicable law and Community Rules.
5.3 No agency
Community Administrators are not agents, partners, joint venturers, or employees of Mera Samaj or Seon Consulting Services. We do not control day-to-day editorial decisions within a Community except through Platform-wide legal, security, and abuse-response obligations.
5.4 Member acceptance of Community governance
By joining or remaining in a Community, you acknowledge that Community Administrators may manage, restrict, or delete your Content and membership in accordance with Community Rules and Platform tools. Disputes about Community-level moderation should first be addressed with the relevant Community Administrator, without prejudice to your statutory rights or our grievance process.
6. Accounts, Security & Fair Use
6.1 Registration
You must provide accurate, current information and keep your account credentials secure. You are responsible for all activity under your account unless you promptly notify us of unauthorised access.
6.2 Single account and accurate identity
Unless we expressly permit otherwise (for example a separate verified business or admin account tied to a Community), each individual must maintain only one personal account registered with their true identity. You must not create duplicate accounts to evade restrictions, impersonate others, misstate your name, matrimonial status, employment credentials, caste, religion, or affiliation, or use another person's phone number without authorisation. Credential sharing, account selling, and fake profiles are prohibited. We may merge, suspend, or terminate duplicate or misleading accounts.
6.3 Automated access prohibited
You may not access the Platform through automated means—including bots, scrapers, crawlers, spiders, bulk harvesting tools, or scripts—except through documented APIs we expressly authorise in writing. Prohibited automated access includes harvesting member directories, matrimony profiles, job listings, marketplace data, chat metadata, or feed content for commercial databases, spam lists, or competing services; bypassing rate limits or authentication; and load-testing or probing without our prior consent. We may block IP ranges, revoke API keys, and pursue legal remedies for abusive automated access.
6.4 Rate limits and abuse prevention
We apply technical limits to protect the Platform, including default limits such as ten (10) posts per rolling twenty-four (24) hour period for regular members unless a Community Administrator configures different limits. Additional limits may apply to comments, listings, OTP requests, API traffic, invitations, notifications, and bulk actions. Exceeding limits may result in temporary errors or account restrictions.
6.5 Suspension and termination
We may suspend or terminate accounts, restrict features, or remove Content immediately if we reasonably believe you violated these Terms, applicable law, or Community Rules; pose a security or legal risk; are a repeat infringer under Section 9.7; or if required by a court, government order, or rights-holder notice. Community Administrators may also restrict members within their Community using Platform tools.
7. User-Generated Content
7.1 Your responsibility
You are solely and exclusively responsible for all Content you create, upload, edit, post, share, transmit, broadcast, syndicate, promote, or delete through the Platform, and for the consequences of that Content. This responsibility applies whether Content appears in social feeds, official community channels, news, chat, voice rooms, matrimony, marketplace, jobs, business listings, events, fundraising campaigns, games, townhalls, microstores, tuition listings, advertisements, SOS alerts, or any other surface.
7.2 Representations and warranties
By submitting Content, you represent and warrant that:
- you own or have all necessary rights, licences, and consents to submit and share the Content;
- the Content does not violate any law, regulation, court order, third-party right, or contractual obligation;
- the Content is not defamatory, obscene, harassing, hateful, fraudulent, misleading, invasive of privacy, infringing of intellectual property, or otherwise unlawful or harmful;
- where Content includes personal data of others, you have provided appropriate notice and obtained required consents;
- matrimony, employment, commercial, and emergency Content you submit is truthful to the best of your knowledge.
7.3 Licence to Mera Samaj
You retain ownership of your Content. You grant Mera Samaj a non-exclusive, worldwide, royalty-free, sublicensable, transferable licence to host, store, reproduce, adapt, format, translate, transmit, display, perform, distribute, cache, back up, index, and otherwise use your Content solely as necessary to operate, improve, secure, and promote the Platform, including enabling Community Administrators to moderate and Community members to view Content according to privacy settings. This licence ends when Content is deleted from our active systems, subject to backup, legal retention, anonymised archival, and technical cache exceptions described in our Privacy Policy.
7.4 Licence among Community members
When you post Content in a Community, you grant other members and Community Administrators the rights necessary to interact with that Content as intended by the feature (for example viewing, commenting, reacting, sharing within the Community, or moderating), consistent with privacy settings and Community Rules.
7.5 No obligation to host
We and Community Administrators may refuse, remove, restrict, or disable any Content at any time, with or without notice, for any reason permitted by law or these Terms. We have no liability for any failure to store, publish, or maintain Content.
8. Prohibited Conduct
You agree not to, and not to enable others to:
- violate any applicable Indian or international law, including laws relating to defamation, obscenity, child protection, hate speech, electoral integrity, securities, consumer protection, data protection, intellectual property, and telecommunications;
- harass, threaten, stalk, dox, or discriminate against others;
- upload malware, conduct phishing, scrape data in violation of Section 6.3, bypass rate limits, or probe or disrupt Platform security;
- use the Platform for spam, pyramid schemes, unauthorised advertising, or deceptive commercial practices;
- misrepresent identity, affiliation, qualifications, matrimonial status, employment credentials, or emergency circumstances;
- share non-consensual intimate imagery, exploitative content involving minors, or content promoting violence or self-harm;
- reverse engineer, copy, or create derivative works of the Platform except as permitted by law;
- use the Platform to infringe copyrights, trademarks, or other proprietary rights;
- collect or use personal data of other users except as permitted by the Platform and applicable law;
- circumvent moderation, privacy controls, E2EE safeguards, or account restrictions.
This list is illustrative, not exhaustive. Community Administrators may impose additional restrictions through Community Rules.
9. Moderation, Reporting, Takedown & Grievance Redressal
9.1 Automated and manual moderation
The Platform may use automated tools, keyword filters, image moderation, spam detection, and human review to flag or restrict Content. Automated decisions may produce false positives or false negatives. We do not guarantee accuracy.
9.2 Community moderation
Community Administrators may review, approve, reject, edit, or delete Content within their Community. Actions taken by Community Administrators are performed under their authority, not as employees of Mera Samaj.
9.3 Complaints and notices
If you believe Content violates your rights, these Terms, or applicable law, you may report it through in-app reporting tools or contact our Grievance Officer (see Section 25). For copyright or trademark complaints, follow Section 10.
9.4 IT Rules compliance
Where applicable under IT Rules 2021 and related law, we will acknowledge grievances within the prescribed period and endeavour to resolve them within fifteen (15) days, or such other period as law requires. Upon receiving actual knowledge of prohibited Content through a valid court order or notified grievance, we may remove or disable access within the timelines required by law.
9.5 No liability for moderation decisions
To the maximum extent permitted by law, Mera Samaj is not liable for any action or inaction relating to Content moderation, removal, restoration, ranking, failure to remove, delay in removal, or any decision by a Community Administrator, whether or not we participated in that decision.
9.6 Repeat infringer policy
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights or repeat violators of Community standards and these Terms. A user may be deemed a repeat infringer after multiple substantiated copyright or trademark complaints, court orders, or serious community-safety violations within a reasonable period. Community Administrators may also remove repeat offenders from their Community; we may enforce Platform-wide bans for coordinated abuse across Communities.
9.7 Good-faith takedown
When we remove or disable Content in response to a complaint or legal notice, we act in good faith based on the information provided. We are not obliged to restore Content unless a valid counter-notice or court order requires restoration under applicable law (see Section 10.4).
10. Copyright & Trademark Complaints
10.1 Notice procedure
If you believe Content on the Platform infringes your copyright or trademark, send a written notice to legal@merasamaj.co.in or grievance@merasamaj.co.in with:
- your name, address, email, and phone number;
- identification of the copyrighted work or trademark claimed to be infringed;
- identification of the infringing Content with sufficient detail (URL, post ID, screenshot, community name) for us to locate it;
- a statement that you have a good-faith belief that use is not authorised by the rights holder, agent, or law;
- a statement, under penalty of perjury where applicable, that the information in the notice is accurate and that you are the rights holder or authorised to act on their behalf;
- your physical or electronic signature.
10.2 Our response
Upon receipt of a complete notice, we may remove or disable access to the identified Content and notify the user who posted it where practicable. We process notices in good faith and in accordance with the Information Technology Act, 2000, IT Rules 2021, and applicable intellectual property law.
10.3 Misrepresentations
Knowingly submitting a false infringement notice may expose you to liability under applicable law. We may share notices with affected users as required for dispute resolution.
10.4 Counter-notice
If your Content was removed due to an infringement complaint and you believe the removal was mistaken or that you have authorisation, you may submit a counter-notice to the same addresses with: identification of removed Content; a statement under penalty of perjury where applicable that you have a good-faith belief the Content was removed due to mistake or misidentification; your consent to jurisdiction of courts in Hyderabad, Telangana, India; and your contact details and signature. We may restore Content after a reasonable period unless the complainant notifies us of court action seeking to restrain the user, or unless restoration is prohibited by law.
11. Messaging, Media, Encryption & Retention
11.1 Chat retention
Unless a conversation uses disappearing messages or you delete Content sooner, we may retain chat message metadata and server-side copies for up to three (3) years to support delivery, safety, backups, and lawful requests. After that window, messages may be removed or anonymised on a rolling basis.
11.2 Disappearing messages
When enabled, disappearing messages are removed from our servers after the timer you select. Brief delivery or backup delays may occur.
11.3 Device-first media
Private chat and distributed media may follow a device-first model: encrypted payloads may reside primarily on user devices, with temporary relay storage during transfer. We may retain routing metadata and integrity checks, not readable media content for end-to-end encrypted sends.
11.4 CDN caching
Images and media attached to feeds, profiles, and community surfaces may be cached on content delivery networks for up to six (6) months unless the underlying Content remains active.
11.5 End-to-end encryption (E2EE)
Where supported, E2EE encrypts message bodies on your device before transmission. We cannot decrypt E2EE content. You are responsible for device security and key recovery. E2EE does not prevent recipients from capturing or forwarding Content.
12. Feature-Specific Terms
12.1 Matrimony
Matrimony features involve sensitive personal information. You are solely responsible for the accuracy of matrimony profiles and interactions. Mera Samaj does not verify identity, background, marital status, caste, religion, income, health, or intentions. We are not a matrimonial bureau and do not guarantee matches, compatibility, or safety of in-person meetings. Meet in public places and exercise independent judgment.
12.2 Marketplace, jobs, business listings & microstores — not party to transactions
Mera Samaj is not a party to any transaction between users. Marketplace listings, job posts, microstore sales, business offers, and related communications are User-Generated Content. We do not guarantee quality, legality, authenticity, delivery, payment completion, employment outcomes, or suitability of goods or services. Users and Community Administrators deal at their own risk. Any dispute about price, defects, refunds, hiring decisions, or fraud is solely between the parties involved. We may remove listings that violate these Terms but we do not arbitrate buyer-seller or employer-applicant disputes.
12.3 Fundraising & donations
Campaign organisers are responsible for lawful use of funds, tax compliance, and truthful representations. Mera Samaj is not a charity regulator and does not audit campaigns unless required by law.
12.4 Events, bookings & amenities
Event hosts and venue managers are responsible for safety, capacity, permissions, and refunds. Platform tools facilitate scheduling only.
12.5 SOS & emergency features
SOS features are supplemental tools only. They are not a replacement for calling official emergency services (such as 112 in India). We do not guarantee delivery, response time, or accuracy of location data. Emergency contacts and Community recipients act independently of Mera Samaj.
12.6 Live audio, video, townhalls & voice rooms
Live audio, video, townhall sessions, and voice rooms may be recorded, transcribed, or moderated by Community Administrators or hosts where the Platform enables such features. By joining a live session, you consent to being seen and heard by participants and to recording where announced or enabled. Hosts and Community Administrators are responsible for obtaining participant consent where required by law, moderating conduct, and complying with Community Rules. Mera Samaj is not liable for participant statements, harassment, unauthorised recordings by other participants, or offline conduct arising from live sessions. You participate at your own risk.
12.7 News & RSS ingestion
News items may include third-party RSS sources or admin-curated Content. We do not warrant accuracy, completeness, or neutrality of news Content.
12.8 AI-assisted features
AI features may process Content locally on your device or in the cloud only when you opt in via Privacy & data settings or equivalent controls. AI outputs may be inaccurate, incomplete, biased, or inappropriate. You must not rely on AI outputs for legal, medical, matrimonial, financial, or safety-critical decisions. You remain solely responsible for Content you publish, send, or approve after using AI tools. Cloud AI processing is optional; disabling it limits cloud-based suggestions but may not affect on-device features that do not transmit Content to our servers.
12.9 Social syndication
Where Community Administrators enable syndication to external platforms, they are responsible for permissions, account credentials, and compliance on those platforms. Mera Samaj is not liable for syndication failures, takedowns, or policy violations on third-party networks.
12.10 Tuition & minors
Tuition listings and youth-oriented features must comply with applicable child-protection law. Parents or guardians must provide consent before minors' personal data is shared through family or tuition modules where required by law.
13. Subscriptions, Payments & Refunds
13.1 Fees
Certain features require paid subscriptions, donations, ad spend, or other fees billed in Indian Rupees (INR) unless stated otherwise. Prices, taxes, and billing cycles are shown at checkout or in admin settings.
13.2 Payment processors
Payments may be processed by third-party payment gateways. Your use of those services may be subject to their terms. We are not responsible for processor outages, chargebacks, or banking delays beyond our reasonable control.
13.3 Refunds
Unless required by applicable consumer law or expressly stated in a separate offer, subscription fees are non-refundable once the billing period begins. Where we offer a satisfaction guarantee, refund requests must be submitted within seven (7) days of payment via 9100003300 or our contact page.
13.4 Community billing
Community Administrators may purchase plans on behalf of a Community. They represent they have authority to bind the Community and to share member data only as permitted by law and Community consent.
14. Intellectual Property
The Platform, including software, design, logos, trademarks, documentation, and proprietary databases (excluding User-Generated Content), is owned by Seon Consulting Services or its licensors and protected by intellectual property laws. No rights are granted except as expressly stated. You may not use our brand assets without written permission.
15. Third-Party Services & Links
The Platform may link to or integrate third-party websites, maps, media hosts, payment gateways, social networks, analytics providers, cloud infrastructure, and communication services. We do not control and are not responsible for third-party services, their content, privacy practices, or availability. Your use of third-party services is at your own risk.
16. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that Community Administrators may access certain member information necessary to administer a Community, subject to Platform permissions and applicable law.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL CONTENT (INCLUDING USER-GENERATED CONTENT) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS.
We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and uninterrupted or error-free operation.
Without limiting the foregoing, we do not warrant that:
- User-Generated Content is accurate, lawful, complete, current, or suitable for any purpose;
- Community Administrators will act fairly, lawfully, or consistently;
- moderation or safety tools will detect or prevent all harm;
- the Platform will be secure, timely, or free from viruses or vulnerabilities;
- any transaction, match, job offer, donation, or emergency alert will achieve your desired outcome.
Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent permitted.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
18.1 Exclusion of damages
Mera Samaj, Seon Consulting Services, its directors, officers, employees, contractors, affiliates, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, or business opportunity; personal injury or emotional distress arising from User-Generated Content or user conduct; or any damages arising from:
- Content created, edited, posted, shared, deleted, broadcast, syndicated, promoted, or moderated by any User or Community Administrator;
- interactions between users online or offline, including matrimony meetings, marketplace transactions, employment decisions, or emergency responses;
- unauthorised access to your account caused by your failure to safeguard credentials;
- interruption, suspension, or termination of the Platform;
- reliance on any Content or AI output;
- actions or omissions of Community Administrators or third-party service providers;
- live session conduct, recordings, or participant behaviour.
18.2 Cap on liability
Our aggregate liability for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of: (a) the total amount you paid to Mera Samaj for the Services in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) INR 5,000 (Indian Rupees five thousand).
18.3 Non-excludable liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited.
18.4 User-generated content carve-out
You expressly acknowledge and agree that Mera Samaj shall have no liability whatsoever for any claim, demand, loss, or damage arising from or related to User-Generated Content or the conduct of users or Community Administrators, except to the extent finally adjudicated to result directly from our gross negligence or wilful breach of these Terms and only within the cap in Section 18.2.
19. Indemnification
You agree to defend, indemnify, and hold harmless Mera Samaj, Seon Consulting Services, and its directors, officers, employees, contractors, affiliates, and agents from and against any claims, demands, actions, proceedings, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- your Content or conduct on the Platform;
- your violation of these Terms, Community Rules, or applicable law;
- your infringement or misappropriation of any third-party right;
- your use of matrimony, marketplace, jobs, fundraising, SOS, AI, live sessions, or other feature-specific tools;
- if you are a Community Administrator, the Content, conduct, configuration, moderation decisions, exports, syndication, recordings, and compliance of your Community;
- any dispute between you and another user or Community.
We may assume exclusive defence and control of any matter subject to indemnification, at your expense. You agree to cooperate with our defence.
20. Release
To the fullest extent permitted by law, you release Mera Samaj and Seon Consulting Services from all claims, demands, and damages of every kind, known and unknown, arising out of or in any way connected with disputes between you and other users or Community Administrators, or with User-Generated Content, except where such release is prohibited by law.
21. Governing Law, Dispute Resolution & Jurisdiction
21.1 Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
21.2 Informal resolution
Before initiating formal proceedings, you agree to contact us at legal@merasamaj.co.in and attempt to resolve the dispute informally for at least thirty (30) days.
21.3 Arbitration
Except where prohibited by applicable consumer protection law or where injunctive relief is sought for intellectual property misuse, any unresolved dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, seated in Hyderabad, Telangana, India, before a sole arbitrator appointed in accordance with the Act. The language of arbitration shall be English. Each party bears its own costs unless the arbitrator decides otherwise.
21.4 Courts
Subject to Section 21.3, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over disputes arising from these Terms. You consent to personal jurisdiction in those courts.
21.5 Class and representative proceedings waiver
To the fullest extent permitted by applicable law, you agree that disputes will be resolved only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this waiver is found unenforceable, the arbitration and court provisions in this Section may be void for that dispute only.
21.6 Consumer Protection Act, 2019 carve-out
Nothing in these Terms limits rights that cannot be waived under the Consumer Protection Act, 2019 or other mandatory Indian consumer law, including rights available to consumers defined under that Act. Where you qualify as a consumer, you may pursue remedies before the appropriate consumer forum notwithstanding arbitration clauses, as permitted by law.
21.7 Time limit to bring claims
To the extent permitted by law, any claim arising from the Platform must be filed within one (1) year after the claim accrues, or it is permanently barred.
22. Termination
You may stop using the Platform at any time and request account deletion under our Privacy Policy. We may terminate or suspend access immediately for breach, legal requirement, repeat infringement, or Platform discontinuation.
22.1 Survival
Upon termination, the following provisions survive: Sections 4 (Platform role and no endorsement), 7 (UGC licences and responsibility), 9.5–9.7 (moderation liability and repeat infringer policy), 10 (IP complaints), 12.2 and 12.6 (transaction and live-session disclaimers), 14 (intellectual property), 17–21 (disclaimers, liability, indemnity, release, disputes), 23 (app store terms), applicable payment obligations, and any other provisions that by their nature should survive.
23. App Store Supplemental Terms
If you downloaded the Mera Samaj app from the Apple App Store or Google Play Store:
- These Terms are between you and Seon Consulting Services, not Apple or Google. Apple and Google are not responsible for the app or its content.
- Your use must comply with the applicable store's terms of service and usage rules.
- Apple and Google are third-party beneficiaries of these Terms with respect to your use of the app obtained through their stores, and may enforce these Terms against you as a third-party beneficiary.
- Maintenance and support obligations are ours alone, subject to these Terms and store policies.
- In the event of failure to conform to any applicable warranty, you may notify Apple or Google for a refund of the app purchase price (if any); to the maximum extent permitted by law, they have no other warranty obligation.
- Product claims, intellectual property claims, and legal compliance questions should be directed to us at support@merasamaj.co.in, not the store operator.
24. Miscellaneous
- Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding the Platform.
- Severability: If any provision is invalid, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: We are not liable for delays, failures, or interruptions caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government orders, labour disputes, power or internet outages, failures of third-party hosting, SMS or payment providers, or acts of hackers not attributable to our failure to maintain reasonable security. During force majeure events we may suspend or limit Services without liability.
- Language: These Terms are drafted in English. Translated versions, if any, are for convenience; the English version controls to the extent permitted by law.
