Community Member Agreement

Important notice: This Community Member Agreement governs your membership in a Community on the Mera Samaj platform. It supplements our Terms of Service and Privacy Policy. By joining or remaining in a Community, you agree to this Agreement. If you do not agree, do not join or leave the Community.
Mera Samaj is a technology platform and intermediary only. We are not the publisher of user-generated content in your Community. Community administrators control moderation, official feeds, and member management.
1. Introduction
This Agreement is between you and Seon Consulting Services, operating the brand Mera Samaj, with operations at 105-3/2/7, Masab Tank, Hyderabad, Telangana, India ("Mera Samaj", "Company", "we", "us", or "our").
This Agreement applies when you join, apply to join, or remain a member of any Community hosted on the Mera Samaj mobile applications, web application, community portals, or related services (collectively, the "Platform"), and when you view, post, comment on, react to, share, or otherwise interact with User-Generated Content within a Community.
Mera Samaj is a technology platform and intermediary only. We provide software infrastructure that enables Communities to communicate, organise, and collaborate. We are not the publisher, editor, author, broadcaster, or guarantor of User-Generated Content posted by members or Community Administrators.
2. Definitions
In this Agreement:
- "Community" means a samaj, association, organisation, chapter, trust, mandal, parish, or other group registered on or managed through the Platform.
- "Community Administrator" or "Community Admin" means a user with elevated permissions to configure, govern, moderate, publish to official channels, export reports, approve members, enable or disable features, and otherwise manage a Community, including roles such as community admin, sub-admin, community head, city head, moderator, leader, and equivalent designations.
- "Community Rules" means policies, codes of conduct, membership criteria, moderation standards, matrimony guidelines, marketplace rules, and other rules adopted by Community Administrators for that Community.
- "Content" means any information, text, graphics, photos, videos, audio, files, metadata, listings, profiles, messages, reactions, comments, polls, advertisements, event details, matrimony data, job postings, business listings, SOS alerts, or other material uploaded, transmitted, generated, edited, stored, shared, broadcast, syndicated, promoted, archived, or deleted through the Platform within a Community.
- "Member", "you", or "your" means an individual who has joined or been approved as a member of a Community.
- "User-Generated Content" or "UGC" means Content that originates from or is submitted, modified, or republished by a Member or Community Administrator, excluding Content that Mera Samaj alone creates and publishes as the Company.
- "Platform Terms" means the Mera Samaj Terms of Service available at /terms-of-service.
Capitalised terms not defined here have the meanings given in the Platform Terms.
3. Community Governance
3.1 Operational control by Community Administrators
Each Community is primarily governed by its Community Administrators, not by Mera Samaj. Subject to Platform-wide policies and applicable law, Community Administrators may, through tools we provide:
- approve, reject, suspend, or remove members;
- publish, edit, promote, demote, archive, or delete posts, comments, news items, announcements, and official feed content;
- configure privacy defaults, feature toggles, moderation levels, rate limits, and membership requirements;
- moderate, flag, reject, or restore User-Generated Content;
- export member reports, analytics, or directory data permitted by their role;
- request promotion of member posts to official channels or syndicate approved Content to external social platforms where enabled;
- appoint sub-admins, moderators, leaders, and other roles;
- enforce Community Rules and remove Content that violates those rules.
3.2 Community Administrators are responsible parties
Community Administrators—not Mera Samaj—are primarily responsible for the Content, conduct, compliance, and member management of their Community. Community Administrators act on behalf of their Community and bear primary responsibility for ensuring Content and activities comply with applicable Indian law, Community Rules, and member consent requirements.
3.3 No agency between Community Administrators and Mera Samaj
Community Administrators are not agents, partners, joint venturers, or employees of Mera Samaj. We do not control day-to-day editorial decisions within a Community except through Platform-wide legal, security, and abuse-response obligations required by law.
3.4 Your acceptance of Community governance
By joining or remaining in a Community, you acknowledge and agree that Community Administrators may manage, restrict, or delete your Content and membership in accordance with Community Rules and Platform tools; Community Rules may impose stricter standards than the Platform Terms; you must comply with this Agreement, the Platform Terms, Community Rules, and applicable law; and disputes about Community-level moderation should first be addressed with the relevant Community Administrator, without prejudice to your statutory rights or our grievance process.
3.5 Membership criteria
Communities may require proof of affiliation, geographic residence, caste or sub-caste membership, business category, or other eligibility criteria. You represent that any information you provide for membership approval is truthful. Misrepresentation may result in removal from the Community and suspension from the Platform.
4. Member Duties and Conduct
4.1 General duties
As a Member, you agree to provide accurate profile and membership information; respect Community Rules and the dignity of other members; obtain appropriate consent before sharing personal data of others; use feature-specific tools responsibly and lawfully; report violations through in-app tools or our grievance channel; and safeguard your account credentials.
4.2 Content responsibility
You are solely and exclusively responsible for all Content you create, upload, edit, post, share, transmit, broadcast, syndicate, promote, or delete through the Platform within a Community, and for the consequences of that Content.
By submitting Content, you represent and warrant that you own or have all necessary rights and consents; the Content does not violate any law, regulation, court order, third-party right, or contractual obligation; the Content is not defamatory, obscene, harassing, hateful, fraudulent, misleading, invasive of privacy, or infringing; where Content includes personal data of others, you have provided appropriate notice and obtained required consents under applicable law, including the Digital Personal Data Protection Act, 2023 where applicable; and matrimony, employment, commercial, and emergency Content you submit is truthful to the best of your knowledge.
4.3 Licence to operate the Platform
You retain ownership of your Content. You grant Mera Samaj a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, format, transmit, display, distribute, cache, back up, index, and otherwise use your Content solely as necessary to operate, improve, secure, and promote the Platform. When you post Content in a Community, you grant other members and Community Administrators the rights necessary to interact with that Content as intended by the feature, consistent with privacy settings and Community Rules.
4.4 Age and capacity
You represent that you are at least eighteen (18) years of age and have legal capacity to enter into this Agreement.
5. Prohibited Content and Conduct
You agree not to, and not to enable others to, within any Community:
- violate any applicable Indian or international law, including laws relating to defamation, obscenity, child protection, hate speech, electoral integrity, securities, consumer protection, data protection, intellectual property, and telecommunications;
- harass, threaten, stalk, dox, or discriminate against others on grounds protected under law;
- upload malware, conduct phishing, scrape data in violation of Platform Terms, bypass rate limits, or probe or disrupt Platform security;
- use the Community for spam, pyramid schemes, unauthorised advertising, or deceptive commercial practices;
- misrepresent identity, affiliation, qualifications, matrimonial status, employment credentials, caste, religion, or emergency circumstances;
- share non-consensual intimate imagery, exploitative content involving minors, or content promoting violence or self-harm;
- infringe copyrights, trademarks, or other proprietary rights;
- collect or use personal data of other members except as permitted by the Platform, Community Rules, and applicable law;
- circumvent moderation, privacy controls, end-to-end encryption safeguards, or account restrictions.
This list is illustrative, not exhaustive. Community Administrators may impose additional restrictions through Community Rules.
6. Community Administrator Moderation Rights
6.1 Scope of moderation authority
Community Administrators may review, approve, reject, edit, hide, archive, or delete Content within their Community; restrict or suspend members; and configure automated moderation filters. These actions are taken under the authority of the Community Administrator and Community Rules, not as employees or agents of Mera Samaj.
6.2 No obligation to moderate
Neither Mera Samaj nor Community Administrators guarantee that all harmful Content will be detected or removed. Automated moderation may produce false positives or false negatives.
6.3 Official feeds and syndication
Content promoted to official Community feeds or syndicated to external platforms by Community Administrators remains User-Generated Content. Community Administrators are responsible for permissions, accuracy, and compliance when publishing to official channels or external networks.
6.4 Member data access
Community Administrators may access member information necessary to administer the Community, subject to Platform permissions and applicable law. You consent to such access as part of Community membership, subject to the Privacy Policy and Community Rules on data use.
6.5 No liability for admin decisions
To the maximum extent permitted by law, Mera Samaj is not liable for any action or inaction by a Community Administrator relating to Content moderation, membership decisions, exports, syndication, or enforcement of Community Rules.
7. Disputes — Community First
7.1 Internal resolution first
If you have a dispute with another Member or with a moderation decision within a Community, you agree to first attempt resolution within the Community by contacting the relevant Community Administrator or moderator; following any internal grievance or appeals process described in Community Rules; and allowing a reasonable period (at least seven (7) days where practicable) for the Community to respond.
7.2 Platform grievance
If internal resolution fails, or if the dispute involves Platform security, unlawful Content, or rights that cannot be addressed at the Community level, you may contact our Grievance Officer (Section 10). We will handle complaints in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021") and our Platform Terms.
7.3 No waiver of statutory rights
Nothing in this Section limits your rights under applicable consumer protection law or other mandatory Indian law.
8. Platform Role and Liability Disclaimer
8.1 Intermediary status
Mera Samaj operates as a technology intermediary under the Information Technology Act, 2000 and IT Rules 2021. We do not initiate transmission of User-Generated Content, select the recipient of transmission (except as necessary for technical routing), or modify Content except for technical operations, security, legal compliance, or automated filtering configured by a Community.
8.2 Not a publisher
We are not the publisher, editor, author, broadcaster, distributor, curator, or guarantor of User-Generated Content in your Community. Display, indexing, caching, syndication tooling, search, ranking, notification delivery, or temporary storage does not constitute adoption, endorsement, verification, or assumption of responsibility for that Content by Mera Samaj.
8.3 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Platform and all Content are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
8.4 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Mera Samaj shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from Community membership, User-Generated Content, or conduct of Members or Community Administrators. Our aggregate liability shall not exceed the greater of: (a) amounts you paid to Mera Samaj in the twelve (12) months preceding the claim; or (b) INR 5,000.
8.5 Indemnification by members
You agree to defend, indemnify, and hold harmless Mera Samaj from claims arising out of your Content, conduct, or violation of this Agreement, Community Rules, or applicable law.
9. Relationship to Platform Terms of Service
This Agreement supplements and is incorporated by reference into the Mera Samaj Terms of Service and Privacy Policy. In case of conflict, regarding Community-specific governance and moderation, this Agreement and Community Rules control in the Community context; regarding Platform-wide legal, security, billing, and intermediary obligations, the Platform Terms control.

Governing law and jurisdiction: This Agreement is governed by the laws of India. Subject to applicable arbitration provisions in the Platform Terms, the courts at Hyderabad, Telangana, India shall have jurisdiction.
